Drunk in Public (Penal Code 647(f))
If you are found in a public place and are under the influence of alcohol, drugs, or a combination of the two, and you are in a condition that you are unable to safely care for yourself or others, you are in violation of Penal Code 647(f). You can also be in violation if you are so drunk, or under the influence, that you interfere with or obstruct the free use of streets or sidewalks.
Under this section, a police officer is required to take you to a “detox” facility for 72 hours if you are under the influence of alcohol, unless certain exceptions apply.
This charge is a misdemeanor and carries up to six months in county jail.
