Assault & Battery
In California, there are several charges of Assault and Battery that can be felonies or misdemeanors. Generally, an assault is an unlawful attempt to commit a violent injury against another person. A battery is a willful and unlawful use of force or violence against another person. The crimes of Assault and Battery are included in the California Penal Code in sections 245, 243, 242 and 240. If these charges allege use of a weapon or cause great bodily injury, you can be charged with a violation of Penal Code section 245, which can be a “strike” offense.
